1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of shopcrashandburn.com (the “Site”) and your purchases from Crash & Burn (“Crash & Burn,” “we,” “us,” or “our”). By using the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

We sell authentic Supreme apparel and select collaborations. Crash & Burn is an independent retailer and is not affiliated with, endorsed by, or sponsored by Supreme or VF Corporation. All trademarks are the property of their respective owners.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. By using the Site, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete.

3. Products, Pricing & Taxes

• Product details: We strive for accuracy in titles, descriptions, sizes, and images. Minor variations in color or fit may occur due to display settings or manufacturing tolerances.
• Availability: Items may be limited in quantity, one‑of‑a‑kind, vintage, or archive. We reserve the right to limit quantities and to discontinue products at any time.
• Pricing: Prices are listed in USD and may change without notice. Obvious errors are not binding, and we may cancel orders affected by pricing or availability errors.
• Taxes: Applicable sales tax is calculated at checkout based on your shipping destination. International customers are responsible for any customs duties, VAT, and import fees.

4. Orders, Acceptance & Cancellations

Your order is an offer to purchase. We may accept or decline any order for reasons including inventory, payment authorization, suspected fraud, or compliance. Order confirmation emails acknowledge receipt but do not constitute acceptance. Acceptance occurs when your order is shipped.

We may cancel all or part of an order and refund you if an error occurs or item is unavailable. If you need to cancel, contact us promptly at [email protected]. We cannot guarantee cancellation after an order is placed.

5. Shipping & Delivery

Shipping methods, timelines, and costs are outlined in our Shipping Information. Delivery estimates are not guaranteed. Risk of loss passes to you upon carrier pickup. For international shipments, you are the importer of record and responsible for customs compliance and fees.

6. Returns & Refunds

Our return windows, eligibility, and procedures are detailed in our Refund & Returns Policy. To initiate a return, follow the instructions in that policy. Items returned used, worn, washed, altered, or missing tags/packaging may be refused or subject to partial refunds.

7. Authenticity & Condition

• Authenticity: We authenticate all items before listing. If you believe an item is not authentic, contact us within 7 days of delivery with evidence; we will investigate and, if confirmed, offer a refund.
• Condition: We display condition (e.g., New, Like New, Gently Used) and disclose notable flaws. Vintage and archive items may show age‑consistent wear. Review photos and notes carefully prior to purchase.

8. Promotions & Gift Cards

• Promo codes are single‑use unless stated, cannot be combined, and are not redeemable for cash. Expired codes are not honored.
• Gift cards (if offered) are final sale, nonrefundable, and redeemable only on the Site. Lost or stolen cards will not be replaced.

9. Accounts & Security

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts for violations of these Terms.

10. Acceptable Use

• Do not interfere with the Site’s operation, attempt to access non‑public areas, or introduce malware.
• Do not use automated tools (bots, scrapers) without our written consent.
• Do not use the Site for any unlawful purpose, including IP infringement or resale that violates brand or territorial restrictions.

All Site content, including text, graphics, logos, and images, is owned by or licensed to Crash & Burn and protected by applicable IP laws. You may not copy, reproduce, or distribute content without our prior written consent.

We may link to third‑party sites or use third‑party payment, analytics, or fulfillment partners. We are not responsible for their content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms.

13. Warranties & Liability

The Site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Site will be error‑free or uninterrupted.

To the maximum extent permitted by law, Crash & Burn will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product at issue.

14. Indemnification

You agree to indemnify, defend, and hold harmless Crash & Burn and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or third‑party right.

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of state and federal courts located in Los Angeles County, California, for any dispute not subject to arbitration (if applicable).
